Defined Terms

1. SMSnia COMPETITION is a competition.
2. Competition Period means such a period as has been stipulated. However iNetMedia reserves the right to revoke such a period should it become necessary.
3. SMS means short text message sent from a cell phone.
4. Virtual SMS means a short text message sent directly from his account without using a cell phone.
5. Competitor means the person who participates in the competition by sending a SMS.
6. Subscriber means a Competitor who has  pre-paid credit to the SMSnia Membership account services and pays for Virtual SMSs on a credit basis deducted from their account.
7. Prize means any product(s) from time to time as stipulated by Us to be competitioned by Us.
8. Our, We or Us means iNetMedia s.r.o. or our authorised representatives, or agencies associated with SMSnia®.
9. Promoter means iNetMedia s.r.o., Moravske namesti 754/13 , 615 00 Brno, Czech Republic, registered number 277 35 371.
10. Related Account means a Competitor that shares the same household address, computer, internet connection or payment method (including PayPal account or credit card) with another member.
11. Winner means the Competitor who has sent the/a winning SMS.
12. Website means www.smsnia.com or relevant Top level domains owned and providing by us.

Competition Rules

1. By sending any SMS in the SMSnia COMPETITION, Competitors are confirming that they have read and understood these Terms and Conditions and are deemed to have accepted them on sending a SMS, regardless of whether the SMS is a valid SMS.
2. SMS entry is open to all people living in the country where the competition is running.
3. Our employees, their immediate families, or the Promoters employees and their immediate families are not permitted to compete.
4. The Competition closing date and time is defined .......
5. Competitors can send enter the Competition via Our Website or by their cell phone. For each Virtual SMS entry sent specified Virtual SMS Credit(s) will be deducted from their Member account. The price of each Virtual SMS can be changed by Us and we reserve the right for these charges to be changed from time to time without prior notice.
6. All SMS entries must be sent by an individual and must not be computer generated. Any computer generated SMS entry will not constitute a valid entry. 
7. Once a SMS entry has been received Competitors will receive a Competition status reply message, notifying them:
   1. How many SMS’s there are left to win. How many competitors are playing against them and how many SMS have been received for the last 30 minutes;
   2. Whether or not their SMS entry wins;
   3. Whether their SMS entry is invalid; 
8. All incoming SMS entries are processed in the order that they are received by the database. We accept no responsibility for any late, delayed or misdirected SMS entries, even if they are as a result of technical failure/disruptions or for any other reason.
9. We reserves the right to verify the validity of any SMS entry and to disqualify any Competitor who tampers with the SMS send process or who send a SMS entry that is not in accordance with these terms and conditions. This may include but is not limited to:

1. Competitors are not permitted to collude with other Competitors to affect the outcome of the competition.
2. The Successful Bidder must provide proof of identity before the Prize will be dispatched.
3. Acceptance of alternate identification as verification is at the complete discretion of We.

1. By sending an SMS entry in the SMSnia COMPETITION, the Competitor is wanting to win the Prize(s) competitioned during that Competition Period. The winning SMS entry on being accepted by Us as a winning SMS will creates the legally binding contract for the Successful Competitor to claim the Prize. This contract is deemed to include the standard terms and conditions of the suppliers of the Prize(s) that the consumer has won to the extent that, despite any other provision:
   1. Ownership and title of the Prize(s) will not pass to the winner until the Prize(s) have been  dispatched to the winner;
   2. All terms, conditions and warranties other than those expressly included in these terms and conditions are excluded, except to the extent that to exclude a provision is not permitted by law.
2. The SMS entry which is in the specific place as stated by US from the start of the Competition will be deemed as the winner for the Prize(s) that are being offered for that particular competition. 
3. The winner of any Prize(s) will be notified at the end of the Competition by text message, to register on Our website and complete their delivery address and to verify their winning code.
4. If the winning code is not received by Us within 14 business days of the winner being notified of their success, the winner will be deemed to have revoked their claim to the Prize(s) and will no longer be able to claim such Prize(s).
5. The Prize(s) will be dispatched to the address provided by the Winner within 30 business days after We receive the signed predavaci protokol.
6. The winner is responsible for payment of all freight & delivery costs associated with shipment of the Prize(s).
7. If the winner is in agreement to provide a high resolution digital photograph of themselves and a short written testimonial, subject to our approval, for use in Our advertising and promotions, the cost of delivery of the Prize will be free. By providing a photograph and testimonial the winner agrees for Us to use, but not limited to, their name, town of residence, state, country, photograph and testimonial in Our advertising and promotions at our absolute discretion.
8. We reserve the right in its absolute discretion to cancel, withdraw, reject, suspend or bar a Competitor and their SMS entry at any stage before winning state.
9. If for any reason the SMSnia COMPETITION is not capable of running as planned due to any reason (including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes), including anything which may corrupt the integrity or proper conduct of the SMSnia AUCTION® we reserve the right to cancel, terminate, modify or suspend the Competition.
10. The collection, use and disclosure of personal information provided in connection with SMSnia is governed by Our Privacy Notice.
11. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other force majeure outside of Our reasonable control, We are reserve the right to cancel, terminate, modify or suspend the Competition.
12. We are not responsible for any incorrect or inaccurate information, caused by but not limited to the consumer or any of the equipment or programming associated with or utilised in the Competition, or for any technical error, or any combination of these which may occur in the course of the administration of the Competition including any act, omission, interruption, deletion, defect, delay in operation or transmission, communication line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of SMSs.
13. No responsibility is accepted for lost, late, incomprehensible or incorrect SMS entries.
14. We will not be deemed liable for any loss or damage suffered (including without limitation direct, indirect and consequential loss and damages) or for personal injury suffered or sustained as a result of entering or trying to enter the Competition or purchasing any Prize(s) offered as part of the Competition or using such item, except for any liability which cannot be excluded by law.
15. Alterations to these Competition Terms and Conditions will only be made by Us and will be posted on Our Website. You are encouraged to check the Website regularly to ensure that you are not affected by any changes to these Competition Terms and Conditions.

Code of Conduct

1. iNetMedia is a competitive community which allows you to connect with others in order to play against them to win prizes.
2. Your use of this website is bound by the rules which have been established to protect any and all user.
3. Failure to comply with these Terms and Conditions and Code of Conduct may result in termination your Member Account and deletion of your content which you may have posted, with or without any prior notice to you at Our sole discretion.
4. Your Member Account allows you to upload and share content with the community and enter competitions by links with any 3^rd Party.
5. We expect you to use your reasonable discretion when uploading content which may be copyrighted and owned by a 3^rd Party and so we expect you not to:

1. Please be aware that when using our website you might be redirected to other websites by hyperlinks or other features, whether provided by Us, another member or any 3^rd Party. These other website may have their own Terms and Conditions which need to be adhered to. We will not be liable for such information or content.
2. You agree and warrant not to use your Member Account or any Services provided for in Our website to:

1. You agree to register for only one (1) Member Account as a single person and not on behalf of another individual, group or entity.
2. You will not impersonate any other person, entity, or falsely state or otherwise misrepresent yourself, your age or any affiliations which you may have or be deemed to have, or to create yourself a false identity.
3. You will not use this website to stalk, groom or act in any way predatory toward any other member.
4. You will not solicit in any way for any personal information or passwords from any other member.
5. You will not use another member’s account for your own purposes.
6. By posting content to the website to automatically give permission and direct Us to make copies for any purpose We deem necessary.
7. We understand that you are free to express your opinion on this Website but We will not allow or tolerate any unacceptable forms of language which we deem are obscene, abusive, sexually explicit, pornographic, threatening, intimidating, harassing/bullying, derogatory, demeaning, malicious, defamatory, offensive or hateful or in any way discriminatory.
8. You will not post any content which in any way depicts graphic or gratuitous violence, could be deemed in any way pornographic, hateful, discriminatory, explicit or harmful in any way shape or form.
9. You understand and agree that We are not a moderator of the content on this website, however, We reserve the right to monitor the conduct of Our members and censor any information made public at Our sole discretion. Meaning that on reviewing the website We can limit access to the site to any persons and/or delete without any prior notice to you any material We deem unfit or violates these terms and conditions.
10.  By contributing content to the website you unconditionally grant Us an irrevocable, non-exclusive, transferable, royalty-free, worldwide licence to exercise all your exclusive rights as the owner of the copyright to the content for any purpose, including sub-licensing any of the exclusive rights which We see fit.
11. You can remove any of your content at any time and in doing so, the licence you granted Us will automatically expire. However you understand that We may still have copies.

Privacy Policy

4. We may share this aggregate information with our corporate/commercial partners, agents, sub-contractors, promoters/advertisers, but we will not share your personal identifiable information without your express prior permission to do so.

Your personal identifiable information will be able to personally identify you. On registering for a Member Account you will be asked to complete personal details which will include but not limited to your name, address with zip code, date of birth, country/state of origin, gender, cell phone number and email address.  We will only use this personal identifiable information to notify you if you become a winning entry in one of our Competitions and in the event you have given express permission to pass this information on to any 3^rd party for any such reason.
6. We use this information to administrate our website and Competitions and which enables us to identify who is using our sites and entering our Competitions. We also record other such information to include responses to our Competitions, any giveaways or promotional material. Whenever a page is opened/requested from our servers we will record such information as the time, date and URL, along with any such browser information which is being used.
7. Where appropriate we may disclose your personally identifiable information, subject to privacy confidentiality protection, to organisations, which could include outsourced service providers who manage services provided to you on our behalf, such as, but not limited to,

1. If you require access to your personally identifiable information for any reason, to include amendments/corrections, please send your request to ... [insert address].

4. Please however be aware that once a cookie is terminated traces of that cookie may still remain on your computer, however these remnants are inactive.

7. We may use cookie when conducting our Competitions and or any polls or surveys.
8. We will never use cookie to retrieve information from your computer that has not been originally sent by us to you in a cookie.
9. Most browsers accept cookie and should you wish to disable or modify your acceptance of such cookies you can do this through your browser, but be aware that this might affect your accessibility to some websites and this could also affect these website functionality.
10. ‘Spamming’ is identified as the sending of mass unsolicited mail which we will only send with your express prior permission to do so unless there is a legal/regulatory/operational requirement for us to do so. If you receive and ‘spam’ mail which you no longer wish to receive please inform us and we will modify our database to record this.
11. For your information we take all reasonable precautions to protect your security. We use encryption technology to ensure the security of the information which you send to us over the internet. However please be aware that there is always a small risk involved when sending information and you do so at your own risk.
12. Your username and password go a long way to help protect your personal information secure and as such we suggest that you keep this information safe and do not pass it on to any other 3^rd party.
13. We will not be held responsible for any unauthorised access to your information if it has been accessed through any unauthorised or improper use of your account or membership due to your failure to adequately keep such username and password secure.
14. Authorised employees and/or contractors may have limited access to your personal information where it is necessary for them to perform relative functions. However, such authorised employees and/or contractors are obliges to keep this information confidential.
15. Any amendments to this privacy policy will be posted on our website so that all users are always aware of the information that we collect and hold, and under what circumstances, if any, we will disclose it.
